Definitions

Consumer – a natural or legal person who wishes to buy, purchases, or could buy a product or use a service for purposes not directly related to their business activity.
Buyer – a person who purchases goods in the Seller’s online store. The Buyer may be either a Consumer or another person who is not a Consumer.
Product – any item offered or sold by the Seller to the Consumer through this website.
Manufacturer – a person who, in the course of their business, manufactures or restores a product for sale or presents themselves as the manufacturer by marking the product, its packaging, or documentation with their name, trademark, or other identifying mark.
Legal acts – the Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”, the Consumer Rights Protection Law, the Civil Law, the Commercial Law, and other applicable legal acts of the Republic of Latvia.
Warranty – a confirmation by the Manufacturer, Seller, or service provider that the product or service will retain its properties, safety, and functionality for a specific period, and that additional commitments are provided beyond those required by law.
Instructions for use – guidelines provided by the Manufacturer or Seller which must be followed to maintain the product’s quality and safety and to avoid risks to the consumer’s property, health, life, or the environment.
Price – the final price of the product indicated on the website, including all taxes and charges. The delivery fee is not included in the product price.
Website – the Seller’s online store at www.erfedumvadi.lv.
Parties – the Seller and the Buyer.
General Terms and Conditions – these rules and conditions that define the terms of use of this website
- General Terms
1.1. These Terms and Conditions regulate the legal relationship between the Buyer and the Seller.
1.2. Before using the website, please read these Terms and Conditions carefully.
1.3. By using the website, the user agrees to comply with these Terms and Conditions.
1.4. The Seller may delete, change, or update any information on the website without prior notice.
1.5. Product images and descriptions shown on the website may slightly differ from the actual product offered.2. Right of Withdrawal
2.1. The Consumer has the right to withdraw from the purchase and return the product within 14 (fourteen) days, covering the cost of delivery, in accordance with applicable legal acts.2.2. The withdrawal period starts:
from the day the product is delivered – if one product was ordered;
from the day the last product is delivered – if several products were ordered in one order;
from the day the last batch or part of the product is delivered – if the delivery is made in parts or batches.
2.3. Exercising the right of withdrawal means that the Buyer notifies the Seller of their decision to return the product and submits or sends the notice to the Seller.2.4. To notify about the withdrawal, the Consumer can use the withdrawal form provided by the Seller or any other free-form written statement, which must include:
Addressee (Seller’s name, actual address, phone number, email address)
A statement such as: “I hereby inform you that I wish to withdraw from the purchase of the following product”
Order date / receipt date
Consumer’s name and surname
Consumer’s address
Consumer’s signature (only if the form is sent on paper)
Date
2.5. The returned product must be delivered to Gaujas iela 32, Mārupe, LV-2167, in full set and packaging.2.6. When using the right of withdrawal, the Consumer may return the product without its packaging if it was not possible to examine the product without opening it or if the packaging could not be preserved (for example, due to its size). In such cases, the absence of packaging is not considered a defect.
2.7. Sending the withdrawal form or notice within the 14-day period terminates the contract and releases the Consumer from any further contractual obligations.
2.8. The Consumer cannot exercise the right of withdrawal if the product is custom-made according to the Consumer’s specifications, clearly personalized, perishable, or has a short shelf life; if the Consumer has opened the packaging of a product that cannot be returned for health or hygiene reasons; or if the product, due to its nature, has become inseparable from other items after delivery.
2.9. The refund for the returned product will be made using the same payment method that the Consumer originally used.
3. Consumer Responsibility
3.1. The Consumer is responsible for any decrease in the value of the product or for using it in bad faith if the product has been used beyond what is necessary to determine its nature, characteristics, and functioning during the withdrawal period.3.2. The Consumer must return the product to the Seller no later than 14 days after sending the written notice of withdrawal.
The Seller (or service provider) must, within 14 days from the day the notice of withdrawal is received, refund the Consumer the full amount paid, including the original delivery costs.3.3. The Consumer is responsible for maintaining the quality and safety of the product during the withdrawal period.
4. Warranty
4.1. The Consumer has the right to submit a claim to the Seller regarding a product’s non-compliance within two years from the date of purchase.
The Consumer must submit the claim within two months after discovering the defect.
The purchase date is considered the day the Seller handed the product over and the Consumer accepted it.4.2. If the Manufacturer or Seller has provided a warranty, the Consumer may submit a claim within the remaining warranty period after the two-year legal guarantee expires, in accordance with the terms specified in the warranty document.
Any claim submitted by the Consumer will be reviewed under the conditions stated in that document.4.3. When submitting a claim to the Manufacturer or Seller regarding product defects, the Consumer must attach a copy of the purchase document.
4.4. The Seller will review the Consumer’s claim within 7 working days after receiving it and will send a response to the address or contact information provided in the claim.
If the claim is considered unfounded and the Consumer disagrees, the Consumer has the right to pursue other remedies provided by applicable legal acts.5. Delivery
Delivery within Riga: €40 (depending on the delivery area).
Delivery outside Riga: €70 (depending on the delivery area).Delivery is carried out within the agreed time.
Delivery hours: Monday to Saturday, 8:00–20:00.If the recipient cannot be reached or is not at home, the order will be returned to the Seller and redelivered to the specified address at another time (an additional delivery fee applies).
The Buyer will be notified when the order is dispatched for delivery.

6. Payment
Payment for the products can be made in one of the following ways:By bank transfer (non-cash payment).
The order will be processed after the Seller has received the payment confirmation.7. Dispute Resolution
Any legal relationship arising from these Terms and Conditions shall be governed by the laws of the Republic of Latvia.In case of a dispute, the Buyer and the Seller will first attempt to resolve it through mutual negotiation.
If an agreement cannot be reached, the dispute shall be resolved in accordance with the procedures established by the laws of the Republic of Latvia.
